Trump Issues New Executive Order Signaling Increased Enforcement of Employment-Based Immigration

On August 3rd, President Trump issued another Executive Order signaling additional restrictions and increased enforcement of employment-based immigration. While it offers little in the way of specifics, the Order instructs federal government agencies to review their federal contracts with private companies to ensure that these companies are not using foreign temporary workers in a way that negatively affects U.S. workers.

As with previous Orders recently, the latest Executive Order also restates the Administration’s intention to increase enforcement and compliance investigation efforts relating to employment of H-1B workers, which may portend the resumption of random “site visits” of H-1B employers by the U.S. Citizenship and Immigration Services’ (USCIS) Fraud Detection and National Security (FDNS) office, as well as an uptick in investigation of employers Labor Condition Application (LCA) public disclosure compliance files by the Department of Labor.
