USCIS Announces New Form I-9 Accommodation for EAD Cards Due to Severe Production Delays

On Wednesday, August 19th, the U.S. Citizenship & Immigration Services (USCIS) announced a new temporary accommodation for employees presenting an Employment Authorization Document (EAD) for Form I-9. Due to severe delays in the production of physical EAD cards, employees whose Form I-765, Employment Authorization Applications were approved between December 1, 2019 through August 20, 2020, and have not been issued EAD cards by the USCIS, may present their Form I-797C, Notice of Action indicating approval, in lieu of the physical card. Employees who use this accommodation must present their physical EAD cards to their employers for I-9 purposes by December 1, 2020.
